The Lazio Regional Administrative Court confirms the stop to the posting of online concessions
The second section of the Lazio Regional Administrative Court, by order, accepted the appeals presented by Sisal, Marathonbet and Microgame, which requested the annulment, after suspension of the effectiveness, of the provision of the Customs and Monopoly Agency, with to which it was communicated "the interruption of the game collection, from the day following that of the deadline". For the Board, in fact, the interpretation of art. 1, paragraph 935, of law no. 28 December 2015, n. 208 (so-called 2016 Stability Law) according to which "the time alignment, as at 31 December 2022, of all concessions concerning the marketing of remote games" would apply, also in relation to the concessions in question. the administrative judges note that parliamentary hearings are underway in view of the adoption of the budget law of 2021 aimed at providing, as part of a broader "reorganization of the public games sector", an express extension of the concessions in question, also in order to allow the execution of the tenders scheduled for 2020 - the completion of which has been postponed due to the health emergency - and to guarantee adequate tax revenue, otherwise entailing the expired and non-renewable concessions the loss of the related tax revenues. Therefore, the College concludes, the acceptance of the concessionaires' request to suspend the aforementioned provision, which gives them the possibility to continue pending the definition of the merits of this judgment, in the remote gaming collection activity managed by it by virtue of the concession in the epigraph, also meets the objective of "guaranteeing the continuity of the relative public service, in compliance with tax authorities, occupational protection and that of players ". The public hearing for the discussion of the merits is scheduled for 6 October 2021.
